The Board of Directors of Dolphin International Berhad ("the Company") wishes to announce that the wholly-owned subsidiary Company, Dolphin Engineering (M) Sdn. Bhd. (“DESB”) had on 4 January 2023 received a Writ and Statements of Claim (“the Writ”) both dated 23 December 2022 filed by Reddi & Co., the Advocates acting on behalf of Sarawak Land Consolidated And Rehabilitation Authority (“Plaintiff”).

The Writ’s cause of action arose from the Agreement No. 05/2014 – Engineering, Procurement, Construction and Commissioning of the Proposed 60/120MT per Hour New Lubok Antu Palm Oil Mill entered by the Plaintiff and DESB on or about 19.06.2014 (“the Agreement”) whereby DESB was appointed by the Plaintiff as the contractor to construct the Crude Palm Oil (“CPO”) Tank at the Plaintiff’s premises. It was alleged that DESB has failed, refused and/or neglected to do the necessary defects and outstanding rectification works for CPO tank. As a result of DESB’s breach of the Agreement and failure to rectify the remaining defects for the CPO tank, the Plaintiff had suffered loss and damages and had to engage in a third-party contractor and/or consultant with approximately RM3,994,400.00 to rectify the outstanding defects and rectification works.

The Plaintiff claims against DESB for:-

a) The sum of RM3,994,400.00;

b) General Damages;

c) Cost;

d) Interest thereon at the rate of 5% per annum from the commencement of the action until date of full and final settlement; and 

e) Such further and/or other reliefs as the Honourable Court may deem fit and proper.

The Company will be disputing the claims and amount.

The Company will make further announcement on any material development on the case.
