- Court of Appeal Civil Appeal No. P-01(A)-379-07/2021 (TF Land Sdn Bhd ("the Appellant") v Tan Chew Hua ("1st Respondent) & Mahkamah Perusahaan Malaysia ("2nd Respondent"))

Reference is made to the Company’s announcement dated 28 July 2022.

 

Further to the hearing of the appeal held on 11 January 2023, the Board of Directors of the Company wishes to announce that the 1st Respondent's judicial review application was allowed at the High Court with the following orders: -


(i) Compensation in lieu of reinstatement for the sum of RM374,000.00;
(ii) Back wages of RM408,000.00;
(iii) Salary in arrears for February and March 2015 for the sum of RM34,000.00, and
(iv) Cost of RM10,000.00 subject to allocator.
 

Upon hearing the Appellant's appeal, the Court of Appeal Judges had unanimously decided to partially allow the appeal as follows: -

 

(i) The 1st Respondent is not entitled to claim for compensation in lieu of reinstatement for the sum of RM374,000.00;
(ii) The High Court Order pertaining to back wages of RM408,000.00, salary in arrears for February and March 2015 for the sum of RM34,000.00 and cost of RM10,000.00 subject to allocator are maintained; and
(iii) The parties are to bear their own costs for the appeal.

 

The Company is in the midst of seeking legal advice against the decisions.

 

Any further material development of the above matter will be announced in due course.
